As the agency charged with regulating oil and gas exploration, production and transportation in Texas, the Texas Railroad Commission holds the key to ensuring a strong and vibrant energy industry in the state. Tens of thousands of Texas jobs depend on the Commission fairly and evenly enacting and enforcing rules that fit today’s energy environment. Texans all over the state rely on the Commission to protect our resources while assuring access to our affordable and abundant energy resources, the availability of which benefits all aspects of the Texas economy. Stakeholders in energy development count on fair and even treatment by the Commission when disputes arise.
But problems exist. The Commissioners have not closely examined and revised the existing regulations for many years – some of the rules do not address the reality of the current exploration and production environment. Further, enforcement is spotty and uneven, often focusing on particular groups of industry participants while some of the worst rule-breakers go untouched.
Enforcement of existing regulations should be uniform. As Railroad Commissioner, I would undertake a systematic and thorough review of each of the rules under which it operates, working to modernize the regulatory framework to fit the current needs of all Texans. This review should not take place in a vacuum, but would include input from everyone. Moreover, I will not shy away from calling for hearings when a significant potential violation of state rules is alleged to have occurred.
Finally, the Texas Railroad Commissioners must promote Texas energy development and use – both as to development of existing energy sources and as our rightful place as a leader in alternative forms of energy and alternative uses for existing energy sources. Done properly, this function can help secure Texas’ energy future for decades to come.
